1. Who you are contracting with

Tildi ("Tildi", "we", "us", "our") is operated by Maximillian James Brown ("the Seller"). By creating an account or otherwise using Tildi, you enter into a binding agreement with the Seller.

2. Acceptance

By accessing or continuing to use Tildi, you agree to these Terms. If you do not agree, you must stop using the service.

3. The service

Tildi is an AI-powered reading companion for children, providing personalised stories, lessons, and voice features. You must be an adult (and have authority to bind your household or organisation if applicable) to create an account on behalf of a child.

4. Account and accurate information

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date.

5. Acceptable use and misuse

You must not misuse Tildi. In particular, you must not:

  • use the service for any unlawful, fraudulent, or harmful purpose;
  • upload or generate content that infringes intellectual-property rights, is illegal, hateful, sexual, or harmful to minors;
  • interfere with security, probe, scan, or attempt to bypass technical limits;
  • introduce malware, scrape, or extract data at scale;
  • resell, sublicense, or redistribute the service or its outputs;
  • reverse engineer or attempt to derive the underlying source code.

6. Intellectual property

The Seller retains all right, title, and interest in and to Tildi, including its software, documentation, models, voices, branding, and content we provide. You receive a limited, non-exclusive, non-transferable right to use the service within your chosen plan.

You retain rights in any content you upload. You grant us a limited licence to host and process that content solely to provide the service. You are responsible for having the right to submit any input you provide and for how you use AI-generated outputs.

7. AI outputs

Tildi uses generative AI. Outputs may be inaccurate, incomplete, or unexpected and should be reviewed by an adult before being relied on. The service is not suitable for, and must not be used as, professional, medical, legal, or financial advice.

8. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Our own Refund Policy sets out the refund window we offer.

9. Service availability

We work hard to keep Tildi running smoothly but do not guarantee that the service will be uninterrupted, error-free, or available at all times. We may modify or discontinue features.

10. Suspension and termination

We may suspend or terminate your access to Tildi for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the service ends and we may delete your data after a reasonable export window.

11. Warranties and liability

To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We exclude liability for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).

12. Indemnity

You agree to indemnify the Seller against claims arising from your content, your unlawful use of the service, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local consumer law provides otherwise.

14. Changes

We may update these Terms from time to time. We will give reasonable notice of material changes. Continued use of Tildi after changes take effect constitutes acceptance.

15. Assignment and force majeure

You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure to perform due to events beyond reasonable control.
